Mediation Is Voluntary
Family mediation is usually a voluntary process. It requires both people to participate willingly and safely.
A mediator may decide that mediation is not suitable or should not continue if there are safety concerns, safeguarding issues, domestic abuse concerns, intimidation, serious imbalance or other risks.
No Guaranteed Agreement
Mediation can help people communicate and explore practical proposals, but it cannot guarantee that agreement will be reached.
Any proposals discussed in mediation are not automatically legally binding. Legal steps may be needed to turn proposals into a binding agreement or court order.
Safeguarding
Confidentiality is important in mediation, but it is not absolute. Information may need to be shared if there is a serious risk of harm, child protection concern, safeguarding issue, threat to life or legal requirement.
